Two short-term rental laws, one town

The Town of Rhinebeck regulates short-term rentals through Local Law 6 of 2024, which added Article 5 to Chapter 125 of the Town Code (filed with the state in May 2024; read 19 September 2026). A short-term rental is any part of a property rented for lodging for not more than 30 consecutive days, and a listing on a rental site for stays of 30 days or less creates a presumption of that use. The main terms:

  • A revocable town permit, valid two years and not transferable when the property is sold.
  • The property must be the owner's primary residence, and the owner must be living there during the rental, in the main house or an accessory building on the lot.
  • At most two guests per bedroom on the floor plan, and never more than 12 in total.
  • Weekly garbage removal during rental periods, in containers with tight covers kept out of sight of the road except at pickup time.
  • A septic system pumped within the past four years, and every four years after that.
  • Rentals in the Rhinecliff hamlet, the hamlet overlay and transition areas and the business district also need a Planning Board special use permit, renewed yearly. Condominium apartments cannot be short-term rentals at all.

The town's website also lists an amended short-term rental law from August 2024; the town clerk can confirm the text in force today.

The Village of Rhinebeck has a separate rule for non-hosted rentals, section 120-17.1 of its zoning code (read 19 September 2026). The house must be the owner's primary residence and offer one to three bedrooms. The village issues no more than 15 permits, chosen by a public lottery each year, with no permit allowed within two lots of another. A permitted house may rent for 16 days in a calendar year with seven days between rentals, to no more than six lodgers, and it passes a Code Enforcement inspection before each annual permit.

Read together, the two laws mean that most short-term stays in Rhinebeck happen with the owner on the property, and that a village house turns over only a handful of times a year.
